These Terms of Service (the “Terms”) govern your use of the website at https://smcterminal.com, the SMC Terminal research dashboard, the AI Analyzer, the blog, live sessions and the Discord community (together, the “Service”), operated by SMC Terminal (“SMC Terminal”, “we”, “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is — and is not
SMC Terminal is a market-research and education tool. It gathers public market data — positioning reports, futures volume and open interest, yields, economic releases, price history and retail sentiment — and presents reads, biases, levels and commentary derived from that data.
Nothing on the Service is financial, investment or trading advice, a recommendation to buy or sell any instrument, or a solicitation. The reads are analysis of historical and current data; they are not predictions and they are not personalised to you. We are not a broker, an investment adviser or a portfolio manager, and we are not regulated as one. Every decision to trade, and its outcome, is yours alone.
Trading carries a substantial risk of loss. Leveraged products can lose more than the amount deposited. Past performance and historical tendencies, including seasonal statistics shown on the Service, do not indicate future results.
2. Eligibility and accounts
- You must be at least 18 years old and legally able to enter into a contract where you live.
- You must give accurate registration details and keep them current. One person, one account.
- You are responsible for everything done through your account and for keeping your password and devices secure. Tell us promptly at support@smcterminal.com if you think your account has been accessed without permission.
- We may refuse, suspend or close accounts that breach these Terms, that we reasonably believe are being shared or used to scrape the Service, or where required by law.
3. Plans, subscriptions and billing
Parts of the Service are free to view; the research modules, the day plan and the AI Analyzer require a paid plan (currently Pro and Pro+). Plan contents and prices are shown on the pricing page and may change for future billing periods; we will tell you before a price change affects a renewal.
- Merchant of record. Payments are processed by Paddle.com Market Ltd and its affiliates (“Paddle”), which is the merchant of record for your purchase. Paddle handles payment, applicable taxes, invoices and payment data under its own buyer terms. We never see or store your full card details.
- Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly, quarterly or yearly, as chosen) until cancelled. You can cancel at any time from your account page via “Manage billing”; access continues to the end of the period already paid for, and no further charges are made.
- Refunds are handled as described in the Refund Policy.
- Complimentary or trial access we grant at our discretion can be changed or withdrawn at any time and does not create a right to future access.
4. AI Analyzer
The AI Analyzer answers questions using the Service's own data and a third-party language model. Its answers can be wrong, incomplete or out of date, and they are not advice. Usage is metered by a credit allowance that is part of the plan; unused credits do not carry over and have no cash value. Do not submit personal data of other people, confidential information or anything unlawful.
5. Acceptable use
You agree not to:
- share your login, resell access, or let anyone else use your account;
- copy, scrape, crawl, frame or redistribute the Service's data, reads or content, whether manually or by any automated means, except as the Service's share features expressly allow;
- reverse-engineer the Service, probe its security, or interfere with its operation or with other users;
- present the Service's output as your own advice to others, or use it to provide regulated financial services;
- post anything unlawful, abusive or misleading in the community or live sessions.
6. Intellectual property
The Service — its software, design, text, figures, methodology, reads and the blog — is owned by SMC Terminal or its licensors and protected by copyright and other laws. You receive a personal, non-transferable, revocable licence to use it for your own research while your account is in good standing. Underlying public data belongs to its publishers (for example the CFTC, the US Treasury, the Bureau of Labor Statistics and CME Group) and is used under their terms.
7. Third-party data and services
The Service depends on data published by exchanges, government agencies and other providers, and on services such as Paddle, Discord and our hosting and email providers. We do not control those sources. Data can be delayed, revised, preliminary (as some exchange reports are labelled) or temporarily unavailable, and a read built on it can be wrong as a result. Links to third-party sites, including partner brokers, are provided for convenience; we are not responsible for their content or services.
8. Availability and changes
We work to keep the Service available and current but do not guarantee uninterrupted or error-free operation. We may change, add or remove features, modules, data sources or plans, and we may suspend the Service for maintenance. Where a change materially reduces what a paid plan includes, you may cancel and we will refund the unused part of the current period.
9. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, SMC Terminal and its owners, staff and suppliers are not liable for any trading losses, lost profits, lost data or any indirect, incidental, special or consequential damages arising from your use of or inability to use the Service, however caused. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded by law.
11. Indemnity
You will indemnify us against claims, losses and costs arising from your breach of these Terms or your misuse of the Service.
12. Termination
You may close your account at any time from your account page or by emailing support@smcterminal.com. We may suspend or terminate your access for breach of these Terms, with notice where practicable. Sections 1, 6, 9, 10, 11 and 14 survive termination.
13. Privacy
How we handle your personal data is described in the Privacy Policy, which forms part of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates, and the courts there have exclusive jurisdiction, without prejudice to any mandatory consumer protections of the country where you live. Before starting any formal dispute, please contact us at support@smcterminal.com — most issues are resolved quickly.
15. Changes to these Terms
We may update these Terms. The effective date at the top of this page shows the latest version; for material changes we will notify account holders by email or on the Service before they take effect. Continuing to use the Service after a change means you accept the updated Terms.
